Woman charged with hate-crime murder in death of man pushed in ...

New York City police officers escort 31-year-old Erika Menendez to a waiting car as she screams in Queens, New York City, on Saturday.

NEW YORK?? A 31-year-old Bronx woman who was seen muttering to herself before shoving a man onto subway tracks in front of a speeding train said she did so because, "I hate Hindus and Muslims," prosecutors said.

Queens District Attorney Richard A. Brown identified the woman as Erika Menendez, 31. She has been charged with second-degree murder as a hate crime, New York City authorities said. In a statement, Brown said that awaits arraignment in Queens Criminal Court.

Menendez admitted to investigators that she pushed Sunando Sen, a 46-year-old Queens resident, on Thursday because of her hatred of Hindus and Muslims, a feeling that stems from Sept. 11, 2001, terrorist attacks.

Sen was born in India and ran a printing shop. He died Thursday night after being knocked onto the tracks. Police released security camera video showing a woman running from the station.

Police said that Menendez was recognized on the street in Brooklyn by a passer-by who called 911. Patrol officers found and arrested her.

Brown's statement said that while in custody Menendez made incriminating statements, saying that she "pushed a Muslim" onto the tracks. Brown also said:

"The defendant is accused of committing what is every subway?commuter's worst nightmare - being suddenly and senselessly pushed into the path of an oncoming train.?The victim was allegedly shoved from behind and had no chance to defend himself. Beyond that, the?hateful remarks allegedly made by the defendant and which precipitated the defendant's actions can never?be tolerated by a civilized society."

The attack was the second time this month that someone was pushed to their death in a New York City subway station. A homeless man was arrested in early December and accused of shoving a man in front of a train in Times Square. He is awaiting trial, and claimed he acted in self-defense.

Further details on how police managed to identify the suspect in Sen's death were not immediately available.

A woman is reportedly in custody in connection with the death of a man who was struck by an oncoming NYC subway.

Investigators had been following up on tips from people who had seen the security video and were checking homeless shelters and psychiatric units in an attempt to identify the woman.

It was unclear whether Menendez had any connection to Sen. Witnesses told police the two hadn't interacted on the platform as they both waited for the train.

But beware: Come April 2014, your tax bill could be huge, and that would make us sad.
3. Dump All Your Investments. In addition to market volatility making stocks wobble, high-income investors are about to get hit with a tax hike on their earnings starting Jan. 1. Meanwhile, the rest of us may as well cash out to take advantage of this year's lower capital gains tax rate; a key proposal in the fiscal cliff negotiations is a bigger capital gains tax bite. Of course, market experts are still anticipating a 10 percent return next year.
4. Tell Your Kids To Drop Out Of School Next Semester. Many of the child-related credits that help lower the tax bill for middle-class families won't extend into 2013 unless Congress acts, which means letting your teenagers skip work to pursue higher education will cost more than ever next year. I recently attended a Manhattan screening of ?Promised Land,? a new feature film written by and starring Matt Damon?and John Krasinski?that aims to examine America?s natural gas drilling boom as a case study in ?what happens when real people and real money collide,? as Krasinski explained in publicity materials.

The film opens Friday in New York City and Los Angeles and then expands to more theaters in early January. My sense is that it will not satisfy many people ? either as a drama or a potential weapon (for either side) in the fight over hydraulic fracturing, or fracking, the drilling method that has opened vast regions of the country underlain with gas-rich shale to exploitation.?

An eager young industry deal closer, played by Damon, is dispatched to rural Pennsylvania to push presumably unwary village folk into leasing their farmland. But he runs into more than he expects ? both from the community and his own company ? and ends up sympathizing with a culture that values land, water and tradition more than money.

The plot has nearly all of the beats, but ? regrettably ? little of the heart and soul of the whimsical, near mystical 1983 film ?Local Hero.? In the new film rural Pennsylvania is a stand-in for coastal Scotland and America?s shale gas bounty takes the place of North Sea oil.

The filmmakers, led by director Gus Van Sant, could have drawn on the real and often wrenching drama in such regions ? the struggle between landowners and politicians eager for a way out of longstanding economic decline and those fearing contamination, industrial hazards or a loss of rural character. In my travels last spring and summer in Pennsylvania and New York communities situated over the gas-rich Marcellus shale, I saw plenty of this. Tom Wilber?s fine book on the gas rush in the Northeast, ?Under the Surface,? probably came out too recently to provide source material for the filmmakers, but depicts the regional tensions in vivid detail. (I recommend that you read Wilber?s thoughtful, informed assessment of the film.)

While the film nicely conveys the textures of small-town life in gas regions, its main characters too often border on caricature.?The industry duo moves from farmhouse to farmhouse, facing a sequence of lone, gullible property owners signing leases over a cup of coffee. That might have been commonplace in 2008 or so in Pennsylvania and other early frontiers in the gas boom, but the norm these days in gas country is?savvy landowner associations?that approach gas deals with skepticism and lawyers.

The plot at first seems crafted to provide no easy answers. An impassioned environmentalist (Krasinki?s character) is as unappealing as Damon and his equally duplicitous partner, played by?Frances McDormand. While the industry team offers town officials manila envelopes stuffed with cash, the activist conducts an absurd classroom demonstration ? drizzling a toy farm with toxic chemicals and then igniting it ? to make his point.

Whether because of budget constraints or by design, the movie never shows drilling itself, leaving the specter of the industrial invasion of rural America to the imagination of the townsfolk and audience. One way or the other, this works to its dramatic advantage.

The central tension in the story surrounds a planned vote by the town that would ban or allow gas drilling. From Ohio through Pennsylvania and New York, there?s been a building push to fight gas drilling by taking control of energy extraction at the local level through home rule.?Tom Wilber, again, is an ideal guide?to how this is playing out (mostly in the courts).

Unfortunately, any prospects of a compelling denouement evaporate in the film?s final act, when the plot veers cartoonishly, doing for the gas industry what John Grisham has long done for big law firms.

Nuance leaves the theater.

In the end, because of such missteps, the tussle?around?the film in recent months between?environmentalists and their allies?and?industry and its supporters?ends up (sadly) more interesting than what appears on the screen.

In a Securities and Exchange Commission (SEC) filing, Apple has revealed that its next annual shareholder?s meeting will take place at their Cupertino headquarters on February 27, 2013, some minor shareholder proposals which, as always, will almost certainly get voted down, and the huge surprise that Apple blew past the financial targets needed for execs to trigger bonuses.

On the matter of Cook?s compensation, while last year Cook?s compensation was listed as $378 million, most of that was in stock awards that Cook will earn over the course of a decade. His compensation this year is his salary of $1.36 million along with a $2.8 million incentive plan, for a total of $4.16 million. For perspective, his compensation last year minus his stock awards was just north of $1.8 million.

When it comes to the proposals at the meeting in February, Apple shareholders have been advised by the board to vote against the creation of a human rights committee because the board feel it would be redundant. Additionally, all board election is expected to see the return of all eight current board members including Chairman Arthur Levinson, Tim Cook, and Al Gore.

NEW YORK (AP) ? Shoes are coming out of the closet and landing under the Christmas tree. They're a top seller this holiday season ? a big feat considering most years they don't even make gift lists.

Laranda Williams, 39, used to buy clothing, tools and electronics as presents for her family. This year, though, she looked at their feet and got inspired. She bought some Vans sneakers for one of her sons, two pairs of stilettos for a girlfriend of another son, and Nike running shoes for her husband.

"Electronics and clothing get redundant," said Williams, who lives in Clarksville, Tenn. "Shoes are just the wow. I know they're going to use it, and I know they're going to love it."

The shoe-gifting fetish is part of a larger trend of shoppers buying loved ones gifts that they not only like, but also can use. It's this habit of practicality that Americans have been clinging to throughout the economic downturn.

This holiday season, it's meant that mom might not buy Molly an extravagant evening gown she'll maybe wear once. But mom may splurge on $600 Jimmy Choo pumps if Molly needs work shoes or $150 Nike sneakers if her daughter's an avid runner.

"It's about practicality and splurging at the same time," said Marshal Cohen, chief research analyst at NPD Inc., a market research firm. "There's a sense of, 'I know what you need but you haven't gotten it for yourself.'"

As a result, footwear was the fifth most popular gift on shoppers' lists on the day after Thanksgiving known as Black Friday, the biggest shopping day of the year, according to NPD. A year ago, shoes didn't even make it into the top 10 gifts for the season.

Overall, sales of cross training shoes rose 16 percent to $197.8 million, and sales of basketball shoes rose 18.7 percent to $353.5 million for the three months ending in November. During that same period, sales of women's fashion footwear grew 3.2 percent to $6.12 billion.

Chelsey Gates, manager of Chuckies New York, a designer shoe store on the Manhattan borough of New York City, said she's seen more men buying shoes for the women in her life. One of the most popular gifts: Chelsea Paris gold trim ankle-high boots for $695.

"Men come in with cards with perfect instructions: style numbers, sizes and prices," she said.

The trend comes as stores have been trying to find ways to boost sales of shoes, which can carry profit margins of up to 50 percent.

As part of Macy's overhaul of its New York flagship store, the department store combined three different shoe departments and expanded their overall size by 10 percent. The new department has 250,000 pairs of shoes, including everything from $99 Nine West leopard print platform pumps to $400 Donald Pliner multi-colored pumps.

"Women love shoes. This is a category that they care about," said Muriel Gonzalez, an executive vice president at Macy's.

This fall, Saks Fifth Avenue also beefed up shoe departments in about a dozen of its stores. The move continues the luxury retailer's efforts at its flagship New York City store, which it first expanded in 2007 to include more shoes, better service and more stock room capability.

The flagship shoe department, which got a second remake this fall, now takes over the 8th floor, which previously also housed a gift area. The department, which is 40 percent larger, now is the second most productive department in terms of sales per square foot, behind the main floor, which sells cosmetics.

In the past few weeks, Elizabeth Kanfer, Saks' senior fashion and co-brand director for women's accessories, said the retailer has noticed boyfriends or husbands walking in with their significant others and buying a pair of shoes that cost at least $595. She declined to offer sales figures.

"There has been a resurgence of footwear easily in the last six years," Kanfer said. "You can easily upgrade your wardrobe with a pair of shoes."

Even smaller chains are trying to cash in on the trend. Fleet Feet Sports-Chicago, a two-store chain of running and fitness apparel, launched a gift registry this year that allows people to record their preferred brand, style, color, size, width and model of shoe from hundreds of options.

Catherine Moloznik, Fleet Feet's product manager, said so far in December, shoe sales are up about 20 percent compared with a year ago, in part because of the registry.

"Shoes have turned the corner in the gift category," said Robert Burke, a New York-based fashion consultant. "They've become the new handbag."

Owen Badillo, 35, certainly never thought of buying shoes as gifts for others in the past. But this season he bought two pairs of $30 Asics running shoes for his 28-year-old sister, who's a mother of two small children and a runner.

Badillo said he's more confident in his gift this year than last year when he ran around trying to pick up clothes for his sister, not really knowing "what she wanted." This year, he said it was clear what she needed.

"Her shoes are all torn up. So I am focusing on what she really needs," said Badillo, who lives in Oklahoma City and works at an oil and gas company.

Richard Adams, early figure in gay marriage, dies

LOS ANGELES (AP) ? Richard Adams, who used both the altar and the courtroom to help begin the push for gay marriage four decades before it reached the center of the national consciousness, has died, his attorney said Sunday.

After a brief illness, Adams died Dec. 17 at age 65 in the Hollywood home he shared with Tony Sullivan, his partner of 43 years, attorney Lavi Soloway told The Associated Press.

Adams and Sullivan met at a Los Angeles gay bar called "The Closet" in 1971, but their life and relationship would soon be on display for a worldwide audience.

They were granted a marriage license in 1975, but for years fought in vain to see it recognized by governments and a population for whom the idea of two married men was still strange and foreign. They were subjected to anti-gay slurs even from government agencies.

"They felt that in the end, the most important thing was their love for each other, and in that respect they won," Soloway said. "No government or no law was ever able to keep them apart."

The couple's public life began when they heard about a county clerk in Boulder, Colo., named Clela Rorex, a pioneer in her own right who took the unprecedented step of giving marriage licenses to gay couples after learning from the district attorney's office that nothing in Colorado law expressly forbade it.

Rorex's office became what The New York Times soon after called "a mini-Nevada for homosexual couples."

Among the first six couples to take advantage were Adams and Sullivan, who traveled to Colorado, had a ceremony at the First Unitarian Church of Denver and were granted a license from Rorex, before the state's attorney general ordered her to stop giving them to gay couples. Rorex remained in contact with Adams throughout his life.

Adams and Sullivan's primary motivation in marrying was to get permanent U.S. residency status for Sullivan, an Australian, and they promptly put in an application with what was then called the Immigration and Naturalization Service.

They received a one-sentence denial from INS that was stunning in its bluntness.

"You have failed to establish that a bona fide marital relationship can exist between two faggots," the letter said.

The INS issued a follow-up response that removed the offending language but gave no ground in its thinking.

Adams' attempt to have that decision overturned was the first federal lawsuit seeking gay marriage recognition, according to the Advocate magazine and the Los Angeles Times, the first media outlets to report his death.

He took the INS to court in 1979, and later filed a separate lawsuit on the constitutionality of denying gays the right to marry.

His position appeared strong. Gay couples always thought they would have to sue for the right to marry in the first place, but Adams was defending a marriage he had been officially granted.

Despite reaching the highest federal appeals courts, he was met only with rejections.

The couple did became a hot topic, especially as Sullivan's deportation became likely in the mid-1980s, and they appeared on the "Today" show and "The Phil Donahue Show," giving some of the first national attention to gay marriage when it was considered an oddity even by future supporters.

Adams' application for Australian residency was also denied, so the couple spent a year in Europe before returning to the United States and leading a low-profile life in Los Angeles.

But they recently reemerged as their issue finally gained traction in courts and voting booths.

They're the subject of an upcoming documentary, "Limited Partnership." And just two days before Adams' death they were working with Soloway on a challenge to the federal Defense of Marriage Act, one of two gay-marriage laws the U.S. Supreme Court has agreed to hear in its upcoming term.

"After 40 years of fighting he missed the outcome at the Supreme Court," Soloway said, "but he felt optimistic."

And he got to see what he deemed a major victory for his particular cause, gay couples and immigration, in October when the Obama Administration issued written policy guidelines saying same-sex couples in long-term partnerships "rise to the level of a 'family relationship'" when it comes to deportation.

"You can draw a straight line from Tony and Richard's efforts in the 1970s to that piece of paper in 2012," Soloway said.
